By registering with our site and/or accessing our service, you agree to be bound by the terms of this agreement. It is your responsibility to carefully read and understand the following Terms of Service provided to you as it is a legally binding document. If you do not agree to any of these terms, please do not use Ernya.com.

Modification

Ernya reserves the right to change, modify, add, or adjust Terms at any time. Your continued use of Ernya after the posting of changes constitutes your binding acceptance of such changes. We advise users to regularly check the Terms and Conditions of this agreement.

Ernya will under no circumstance be liable for indirect, special, or consequential damages, including any loss of revenue, profits, or data in relation to your use of ernya.com.

Privacy

Your privacy is very important to Ernya. Ernya's Privacy Notice is hereby incorporated into these Terms by reference. Please read this notice carefully for details relating to the collection, use, and disclosure of your personal information.

General Use

When using Ernya.com, you will be subject to any additional posted guidelines or rules including but not limited to Ernya's Rules & Guidelines and the "Announcements" or "Stickies" made anywhere within the website itself.

Password

When you register to Ernya.com, you will be asked to provide a password for your account. Your password is confidential and should not be shared with anyone for any reason. Administrators or moderators will never ask you for your password. You are solely responsible for maintaining the confidentiality of your account and password. If you have a reason to believe that your account is no longer secure, you will immediately notify Ernya. You may be held fully liable for any damages made to Ernya.com or the members within it during this time.

Account Sharing

In many cases users would like to jointly create shops such as price guides, charities and other projects. If an account is needed as a ìmuleî for any purpose, we require that both users together decide on a secure password that differs from their main account on Ernya.com or anywhere else. Both users will be held fully responsible for any damages that might occur from misuse.

Prohibited actions

"stalk", harass, threaten, verbally abuse, flame, or defraud other Ernya users or staff members.
send, post, or make available pornographic, threatening, embarrassing, hateful,false, defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually explicit, racially or ethnically insulting, libelous, or otherwise inappropriate messages to other Ernya Members.
purposefully interfere with the goings on of Ernya.com and any memberís enjoyment thereof, or purposefully posting any provocative statements by sole means of getting emotionally charged responses (also known as ìtrollingî).
fail to deliver payment for any purchases made on Ernya.com.
make unsolicited offers, advertisements, proposals, chain letters, or send junk mail, to other Members.
use Ernya.com at any time for any illegal purpose such as using an auto refresher, FLP, bot, or offsiting for gold and/or pixel items for real money.
impersonate another user or a staff member for any reason &/or access another Member's account without permission.
interfere with, modify, or disable any security-related feature of Ernya.com, exploiting glitches for gold/item gain, and/or hacking into the site for any reason.
misrepresent the source, identity, or content of information transmitted via Ernya (i.e. plagiarism).
share your password with anyone (Ernya.com will not be held responsible for lost items, postings or any other actions performed by another user on your account).
scamming users in any way.

Violations

You agree that Ernya, in its sole discretion and for any or no reason, may terminate any account you may have with Ernya or your use of Ernya and remove and discard all or any part of your account including its inventory of any virtual items, heart, gold, profile, or any submission, at any time.

Any fees paid hereunder are non-refundable.

You understand that violations of the Terms of Service can result in termination of your account without any prior notice.

Eligibility

Ernya is not available to persons under the age of 13 or to any Members suspended or removed from Ernya by Ernya administrators or moderators . You agree that the information you provide to Ernya during Member registration and, at all other times, will be true, accurate, current and complete.

Copyright

All intellectual property of Ernya.com, such as trade names, patents, registered designs, and all automatic intellectual property rights that are derived from the functionality or aesthetics of the site remain wholly the property of Ernya.com.

By agreeing to these Terms of Service, you agree to respect the intellectual property rights of Ernya and will not copy, download, reproduce, or reprint for any profit, any material contained within the website of Ernya.com.

Ernya or third parties may provide, links to other World Wide Web sites or resources. Ernya has no control over such sites and resources, and is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products or other materials on or available from such sites or resources. Access and use of linked sites, including the information, material, products, and services on linked sites or available through linked sites, is solely at your own risk.

Messaging

You are welcome to post, transmit, or otherwise submit ìmessagesî throughout Ernya.com. Ernya.com accepts no responsibility for its membersí message postings, nor does it endorse, have control over, or give prior approval to member-submitted messages. By using Ernya.com, users acknowledge that they may encounter written words or materials posted by other Ernya members or staff that they personally find offensive. Messages submitted throughout the site do not necessarily reflect the thoughts or opinions of Ernya.com. Ernya.com reserves the right to prevent its members from submitting content, and to edit, restrict or remove the messages posted for any reason and at any given time.

Items

All items are owned by Ernya, and Ernya reserves the right to take them away at any time.

Gold, Hearts and other Virtual Currency:

Throughout your Ernya experience, you may accumulate "Gold" or "Hearts" which constitutes a limited license right to use a feature of Ernya when, as, and if allowed by Ernya. Gold and hearts are the fictional currency used in the world of Ernya and it may be used to purchase virtual goods or virtual services which are stored in the Member's inventory or shop and can be used to enhance the look of on-line character, also known as an "Avatar", or other on-site features. Ernya may charge fees for the right to use Gold or Hearts, or may distribute Gold or hearts without charge, in its sole discretion. Regardless of terminology used, Gold/Hearts represents a limited license right governed solely under these Terms, has no real value, and is not transferable or redeemable for any sum of money or monetary value from Ernya at any time. You agree that Ernya has the absolute right to reduce, manage, regulate, control, modify and/or eliminate Gold/hearts as it sees fit in its sole discretion, and that Ernya will have no liability to you based on its exercise of such rights. Ernya may halt, suspend, discontinue, or reverse any Gold transaction (whether proposed, pending or past) in cases of actual or suspected fraud, violations of these Terms or other laws or regulations, or deliberate disruptions to or interference with Ernya. All Hearts bought on Ernya are seen as donations and are non-refundable under any circumstance.

Payments

If you purchase a Donation Item, buy "Hearts" or "Gold" to purchase virtual merchandise or services, or otherwise buy products or services from Ernya, then you agree to pay for any such purchases, products and services and we may charge your selected payment method to collect any such payments. You are required to keep your billing information current, complete, and accurate (such as a change in billing address, credit card number or expiration date) and notify Ernya if your selected payment method is cancelled (e.g., for loss or theft).

You are responsible for all charges incurred under your account made by you or anyone who uses your account (including your children, family, or friends). If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms. Your account may be deactivated without notice to you if payment is past due, regardless of the dollar amount. You are also responsible for paying any governmental taxes imposed on your purchase from or use of Ernya, including, but not limited to, sales, use or value-added taxes.

Termination

Ernya may in its sole discretion and at any time discontinue providing access to Ernya.com, or any part thereof, with or without notice. You agree that any termination of your access to Ernya or any account you may have or portion thereof may be effected without prior notice, and you agree that Ernya shall not be liable to you or any third party for any such termination.
